New California Sending Civil Rights Complaints to All California Counties

The movement behind the creation of the state of New California has sent civil rights complaints to all California counties regarding how they conduct elections.  Not one county is in compliance with federal or state law.  

Here is what the complaints state:

This complaint is written to inform as well as to document: each section explains what the governing law requires before stating what Orange County has done and why it constitutes a civil rights concern. NCS LAD submits this complaint to the U.S. Department of Justice Civil Rights Division, Voting Section, documenting Orange County’s withholding of federally mandated election audit records for the November 5, 2024, Presidential General Election — conditioned on a $5,399.86 fee demand not authorized by Government Code §7922.575(b) for pre-existing, automatically generated native system files — and the civil rights consequences of that conduct for every Orange County voter who cast a ballot in that election.

This complaint documents three distinct civil rights concerns arising from the same underlying conduct. First, a structural concern: the denial of access to audit records makes it impossible to detect, investigate, or remedy any counting error or voting rights violation that may have occurred in the November 5, 2024, General Election in Orange County. The right to have one’s vote accurately counted is hollow without the ability to verify that it was. Second, an Equal Protection concern: identical Public Records Act requests filed the same day with all 58 California counties have produced responsive records from other counties administering the same federal election — and the same county applied materially identical fee language to deny audit log access to another requester in December 2024 — creating a documented structural access disparity. Third, a §1983 concern: county officials, acting under color of state law, invoked state statutory authority that does not authorize the fee demand for these records.

This complaint is not predicated on identified fraud or a specific counting error. It is predicated on the denial of access to the records that would allow such findings to be made or excluded.

That denial is itself the civil rights concern.
