You can’t make this up – Jim Comey’s attorneys reportedly doctored transcripts when providing documents in his perjury trial.

Paul Sperry shared some observations on the documents that Comey provided to the courts in his perjury case.  One observation is shocking.  According to Sperry, when presenting evidence in a motion to the court as part of his perjury defense, James Comey’s legal team altered two words in a transcript of his 2020 Senate testimony to make it seem as if Sen. Ted Cruz asked Comey a key question he didn’t actually ask him during the hearing.  YOU CAN’T MAKE THIS STUFF UP.

The answer is:

No, a defendant cannot alter words in a transcript that is presented as evidence in a trial. Transcripts are official records that accurately capture what was said during legal proceedings. Altering them would be considered fraud and could lead to serious legal consequences, including charges of contempt of court or tampering with evidence.

Not so good for Comey.

His “super” attorneys also reportedly used a movie to support their argument in Comey’s case.

In their defense, Comey and his friend claimed they did nothing wrong, but they hid their identities in doing it.

In addition, in Comey’s effort to claim vindictive prosecution, Comey’s attorneys have to do much more than they have to date.

It looks like Comey’s associates, accomplices, and attorneys will fabricate anything and insert it into the court documents to make their point.  Not good.

  11. We work in the law and see this all the time in documents produced in discovery by the defense . Common practice that requires experts with the deep knowledge of the industry to catch this.

  29. If any of Comey's attorneys signed a verification page as part of their motion or presentation, they may be subject to prosecution for perjury by the Court, and must withdraw as counsel. They should, at the very least, be subject to professional discipline, and possibly disbarred.

  33. actually presenting know false transcripts would be perjury because the attorneys would have to represent that the transcripts were a true and accurate copy. This can be charged as a felony and could result in the attorneys being disbarred. This would also be a 'Brady Issue' and could result in Comey having to obtain new representation.

  42. The story doesn’t provide the authentic and correct transcript copy nor the alleged doctored copy, which is the most important part.

  43. There is something very fishy about this story. First off, we don’t know what was changed. Seems to be a very critical piece of information that is missing. Second, I am assuming that Comey’s attorneys are at least mildly competent so why would you submit to the court a document that could easily be refuted? Especially with the penalties associated with this kind of behavior. This just doesn’t add up.

I was the defendant in a civil lawsuit where the Plaintiffs attorney openly admitted that he doctored a document, which a previous copy had already been entered into evidence, and he was attempting to enter it again. Blatantly obvious. When this was pointed out to the Judge, the Plaintiffs attorney said "I wrote that on the document, not my client", admitting that it was himself who doctored evidence. The Judge just poo-pooed the situation and said 'well, you can't submit a document that is already in evidence a second time. Just take this document back.' All this over our objection.

      The system is, Judges protecting their brethren.

    Did they actually believe that they would not get caught? The original transcripts from the hearing are public record. All you have to do is compare what is submitted to the original, and you will see any changes that have been made.

          • Lawfare is applying the law in an implicit manner. Allowing fraudulent documents would constitute a breach of judicial law. The judge can get into real trouble very quickly, especially since it’s so obvious.

            How she addresses the fraud will likely determine how the case is handled overall, meaning that if the lawyers do not face professional sanctions, including disbarment, monetary fines, or even criminal charges. It will set a precedent that will quickly be challenged, and I don’t believe it will hold up in any appeals court.

    • The article states the alteration made it appear Sen. Cruz asked a question which wasn't asked and YES! Lawyer's have to faithfully reproduce testimony from transcripts in ALL legal cases.
