The UnderDog Says:

In Part 1, we reviewed the four aspects of the Jewish Law in the Old Testament and began related them to our modern-day law:

  1. RISK
  2. RESPONSIBILITY
  3. RESTITUTION
  4. REHABILITATION

Last week, we established that Risk is unavoidable in today’s world and as a result, we have been given responsibilities to protect us, others, and our property from this risk.

We then reviewed that God respects the ownership of personal property and how that contributes to every individual’s freedom and their ability to fully express themselves. Any government that unfairly restricts or seizes personal property, for example a communist government, would not be one that God would condone. We discussed the risks associated with a 2005 ruling by the Supreme court allowing Eminent Domain (The seizing of personal property by a Government) to be used for benefit of private corporations. Although some states have passed legislation to limit the power this ruling, its intent goes against the very right of a country’s citizen to be protected by seizure of their property by a government.   1. RESPONSIBILITY AND PERSONAL PROPERTY (Continued from last week)

With great risk, comes great responsibility. God honors the right of people to “own-their-own” property and the best governmental system is one that is via a government that allows private property rights.[1]

UNREASONABLE SEARCH AND SEIZURE

The Fourth Amendment states:

“[It is]…the right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

In other words, there should be no seizure of proper without:

  1. A warrant issued with
  2. Probably cause

But this is no longer the case. In 1984, President Reagan enacted the Comprehensive Crime Control (CCC) Act, which enhanced the ability of police officers to seize cash from anyone and everyone suspected of a drug crime.[2] The intend was to starve out the illegal drug trafficking. It didn’t work. It has not effectively reduced crimes associated with drugs, but it did end up enriching many police departments and officers of the law.  It legalized graft.  Here how it could work:

You are driving on the way to buy a used car for cash and have $20,000 with you. You get pulled over for a broken brake light and the officer has a “hunch” you are in the act of committing a crime. He searches your car, finds, the $20,000, seizes it and your car.  You are presumed guilty with no chance to prove your innocence. You have no almost way to get your money or your car back, based only on a hunch.

 

POLICE USE CIVIL FORFEITURE FROM THOSE WHO CAN’T FIGHT BACK

A Forbes article about the Police and courtroom in Philadelphia about “predatory civil forfeiture scheme that operated from a shady ‘courtroom’ at City Hall.”[3]

 “For years, police and prosecutors seized cash, cars and even homes and then took the property for themselves. Worse still, new data show that the police preyed on people in minority and low-income areas—in other words, people who could least afford to fight back.”[4]

“…civil forfeiture posed a major conflict of interest: the police got to keep whatever assets they seized. This gave them tremendous incentive to…up the seizure game…In one case…authorities broke into a computer retailer’s safe and took  $120,000 in cash. [He was never] charged with a crime; all the police needed was a “hunch”…There was no burden of proof.”[5]

It’s time to end the CCC Act. Any time there is a financial benefit to a person or organization for anything, people will find a way to distort it to their advantage. Here are five aspects of Civil Forfeiture that the Institute For Justice points out:

POLICE FOR PROFIT[6]

  1. Profit Incentive:In 43 states, police and prosecutors can keep anywhere from half to all of the proceeds they take in from civil forfeiture—a clear incentive to police for profit.
  2. Equitable Sharing: Under this federal program local and state law enforcement can bypass state laws that limit civil forfeiture. By collaborating with a federal agency, they can move to forfeit property under federal law and receive up to 80 percent of forfeited proceeds. Granting Law Enforcement a direct financial stake in federal forfeiture litigation encourages profiteering and a lack of respect for federalism and state sovereignty.
  3. Standard of Proof:  Nearly all states and the federal government require far less evidence than the “beyond a reasonable doubt” standard for criminal convictions.
  4. Guilty Until Proven Innocent:While many civil forfeiture laws do have a process for innocent owners to reclaim their property, all too often the burden of proof is on the owner—not the government. Therefore, under civil forfeiture, property owners have to prove their innocence and show that they were not aware of any criminal activity.[7]

EXCESSIVE TAXATION IN THE BIBLE

Excessive Taxation is another way Governments limit its citizen’s ability to own property. The more they take, the less you have. One of the main points of the American Revolution was the lack of “Taxation Without Representation.” The people had no say of what their taxes were since they were controlled by a monarch in England. But in all honesty, seeing where we are today, the present system of “Taxation with Representation” does not look any better. We seem to have no say what our taxes are going to be or how our Government spends (or mis-spends) our tax dollars. We are now at $37 Trillion Dollar in dept, and that does not even count the other Government obligations. It was reported last week that Medicare and Social Security are underfunded by $175 trillion![9]

God has severe dislike of over taxation, especially when it is used for personal gain.[10] In 1 Kings chapter 12, and in 2 Chronicles chapters10-11, there is the record of Jewish people who complained about over taxation by Solomon after he died. This was between the Northern and Southern Jewish kingdoms. The new king responded to the people saying he would greatly increase the taxes. As result, an army with 180 thousand troops was put together to do battle. This was that almost a Civil War between the two Jewish kingdoms, but God sent a prophet to stop the fighting and the battle was averted.

In another record, God said he would punish the Prophets and Priests, for their greed of over taxation practices by taking away their wives and the land they had seized from others.[11][12]

Finally, Jesus strongly admonished the Pharisees, and some of the scribes for taking peoples’ goods and finances which were supposed to be used to support their parents in their older years. They had them “donate” this to the temple under the “corban” rule, leaving their parents with no support.[13]

Give to Cesar what is Cesar’s and give to God what is God’s. Although God does not support over taxation, he does not want us go to  Should We Obey God or Man-Part 1 for more background on this topic.

In closing, God’s laws are a blessing to the government and its citizens. It is also blessing to investigate how God recommends handling different situations and apply these to today’s laws. We will continue this series next week with Part 3, of Modern Law and the Bible.
