A federal judge has ruled that the State of Missouri must allow a voter’s federal election complaint based on Unite4Freedom analysis to proceed under the Help America Vote Act (HAVA), ordering the Missouri Secretary of State to accept the complaint, conduct a formal hearing, and issue a written determination within 90 days.

The decision comes after the State previously rejected the complaint based on a Missouri regulation requiring complaints to be filed within 30 days after election certification. The court ruled that state procedural rules cannot be used to block federally protected rights established by Congress under HAVA.

The court’s order requires the Secretary of State to process the complaint through the federal HAVA complaint procedure, including a hearing on the record and a written determination. The court also ordered preservation of key election system records while the complaint is investigated, including statewide voter registration database records, voter history records, audit logs, and related election system data. These records may be relevant to determining whether election systems are operating in compliance with federal requirements.

Importantly, the court stated that the plaintiff obtained the full relief requested in the complaint and that the court will retain jurisdiction for 90 days to ensure compliance with the order.

The Complaint

The HAVA complaint filed by the plaintiff centers around a simple analysis in Unite4Freedom’s Election Validity Scorecard demonstrating that the state’s certified vote tallies from the 2022 and 2024 did not match the EAC vote tally or the state’s voter history records.

HAVA § 303(a)(1)(A) requires each state to implement a “single uniform, official, centralized, interactive computerized statewide voter registration list” maintained at the state level with a unique identifier for every single legally registered voter. § 303(a)(1)(A) further requires that this single statewide list serve as the official list for the conduct of all federal elections in the state. If different “official” channels produce different totals for the same election, the State is not operating off one authoritative list.

What the Ruling Means

The ruling does not determine whether any election law violations occurred. Instead, “This case is about ensuring that federal election law is followed,” said plaintiff, Connie Kramer. “Congress created a process under the Help America Vote Act so that citizens can raise concerns about election administration and receive a formal hearing and determination. The court confirmed that states cannot block that federal process with procedural technicalities.

The court also emphasized that the ruling does not address the underlying merits of the allegations but ensures that the federally required process will occur. “This ruling reinforces a simple principle,” the plaintiff added. “Federal election law applies to every state. When Congress created a complaint process for violations of HAVA, it meant for that process to be accessible to citizens.”

National Significance

While the decision applies directly to Missouri, the ruling carries potential national implications because the Help America Vote Act establishes uniform federal requirements for election administration across all states.

Legal observers note that the decision reinforces several key principles of federal election law:

  • Citizens have the right to file complaints under the federal HAVA complaint process.
  • States cannot use procedural rules to deny access to federally mandated complaint procedures.
  • Courts may enforce the federal complaint process when states refuse to provide it.
  • Election system records may be preserved and examined when compliance with federal election law is questioned.

Because every state that receives federal funding under HAVA must comply with its requirements, the reasoning in the ruling may be cited in future cases involving election administration and access to the federal complaint process.

This ruling will be used in citizen complaints going forward. Remember in 2020 when no one had standing? This ruling will be used as precedent in future citizen complaints against states who violate their civil right to a free and fair election.

  1. Then, why, after the 2020 election, were so many cases dismissed on standing? Sounds like those judges violated HAVA by not letting citizen complaints be heard in court.

    • I still wonder how it is a judge can simply say an American citizen concerned about illegal elections can have no standing in their courts…

      • Easy. The fix was in.
        Trump was beating them so badly, they got careless. At that point, they needed to do two things. First, they needed those cases to get before THEIR judge, ad that judge had to stop ANY from proceeding…or their goose was cooked.
        Every judge who denied standing to a voter to question election results should be in prison for life.

    • I would venture to guess that it was because of a two-tiered justice system with Democrats in Control.

      • Even IF they pass the SAVE America act, that's no guarantee these criminals will follow the law. Think about how many election laws they're already breaking now. What good is one more law when they still have S0r0$ judges and DA's?

    • Actually, those judges protected our ability to get a fair trial (after the activists are identified, and/or removed) like a parking lot protects future farmland.

      If this went to court without all the hard evidence we have gained and are still gaining, the verdict would be awarded to the states, and double jeopardy would prevent further action..

    • Congress should drag every one of those A hole judges before a comity and have them explain themselves, and if they can't, impeach.

  3. EAC is "Election Assistance Commission" and MCVR is the "Missouri Centralized Voter Registration".

    Excuse me if I missed an explanation of these acronyms in the article but I looked more than once than looked them up elsewhere.

    • WI has 5 million residents over the age of 18 who could vote. The state voter rolls contain 7.5 million registered voters!

      • This is why Asst. AG Harmeet Dhillon has to sue 26 states because of their refusal to provide certified lists of their state's voter rolls. Lest it is discovered hundreds of thousands of illegals, other non-citizens, dead, under age, moved out of state and fictitious persons, phony addresses are still listed on those rolls.

        • Lived in Calif since 1967. As of 2022, Judicial Watch revealed the state had over 1.5 million more people registered than eligible to vote. 1.08 million in L.A. County alone.
          Recall, in 2008 there were many precincts in many states which had at least 40% registered Republicans yet the vote totals were 100% for Obama.
          Methods of fraud are many, thousands involved and the scope is vast. Even foreign countries like China are involved.

          • I was born in Commiefornia and lived there until 2005. I registered to vote just after the GE in 2000 when I turned 18. I moved out of state in 2005 and am sure my voter information is still on their roles even though they deny it

        • The fraud in DELCO is still making its way thru the courts. The dirty dems in Chester locked out people and the DELCO democrat Sheriff ordered his staff out. Of course the dirty dems and Union toadies in DELCO were all ok with this.

          • 200,000 more ballots cast in PA then the number of people who voted.

          • 460,000 absentee ballots in GA that they are unable to account for.

          • Multiple ballots submitted by the same people.

          • Numerous ballots all with the same address and in the same handwriting.

          • Thousands/millions of ballots with addresses that were actually empty lots, casinos, restaurants, Post Offices, Stadiums, Schools, Churches, College campuses, etc.

          • Thousands of ballots returned before they were even received by the voters.

          • Brand new absentee ballots with no creases in them counted.

          • Thousands of votes for Biden from dead people.

          • Snowbirds voting in two States

          This is just part of the information that I have.

    • Remind me, in how many States did Obama receive more than 100% of the vote in his two elections.

  6. This federal ruling ought to be used against every Secretary of State. Especially for Michigan, Arizona, Colorado, Commiefornia, Nevada, Georgia, Pennsylvania, New Jersey, New York, Illinois, Minnesota, Wisconsin, New Mexico, and Taxachuettes.

  8. Just how much money has Soros spent on corrupt Secretary of States and District Attorneys throughout this nation. And what's sad is that most of the funds he spent went thru an NGO that was previously funded with our own taxpayer monies.

  9. Of the 97 Lawsuits filed in the immediate aftermath of the 2020 Election a total of 74 were dismissed due to Standing without any evidence being adjudicated.

    That ANY judge could rule that Americans do not have Standing to sue over their own elections is beyond me but that's what happened.

    Of the remaining 23 a total of 17 were found in favor of the Plaintiffs (Trump or Republicans)

    One case in Nevada the Judge ruled that although the Plaintiffs would likely prevail in their attempts to prove as many as 493,000 illegal ballots were cast he still dismissed the case because in his words the requested Remedy ….
    Overturning all or part of the Election … "was a bridge too far"

  10. Unless EVERYONE and EVERYTHING that stole 2020 and 2022 is "addressed" in the most permanent of fashions, elections will NEVER be honest ever again. ONLY through a public display of the harshest of punishments can we ever hope to send the appropriate message to the folks who will attempt it again (as they are planning for the mid-terms I'm sure). And in that group I INCLUDE REPUBLICANS, as they OBVIOUSLY worked against Trump, work tirelessly to prevent GOOD candidates from getting past the primary hurdles, and they BOTH work against any independent or third party candidate who supports freedom and liberty.

    Our parties and government are even telling us now that we must gerrymander our districts in order to win congress. They aren't even trying to hide this from anyone anymore.

  16. Colonel Allen West lost a House race in Florida in St. Lucie County, years ago. More votes counted than there were registered voters in the county. Nothing happened. Gary Peters won a Senate seat in Michigan where Republican poll watchers were blocked AND, he won as a not so good looking milquetoast older white guy against a young, good looking, successful businessman and combat veteran WHO IS BLACK, in Wayne County. No way the old white dude beat a successful young black man in that county. Dead people voting, votes arriving in the middle of the night by the van load with no security. Nessel and Benson were re-elected by the same people (same county) under suspicion. Do you think the SoS was going to question results where she and the Democrat party were involved in questionable results? FIX IT NOW!

  17. Every US citizen has standing in federal elections. Just because you don’t live in a particular state does not mean that the outcome of their elections will not affect you. You should have the right to sue if you think there was fraud.

  18. Every aspect of voter integrity needs to be corrected.. forget "investigated". We have already seen the corruption and fraud.

  20. Remember in the 3,000 lawsuits filed against Obama claiming he was ineligible for the Office? All dismissed on hyper technical grounds. Not one case allowed to go into discovery. It will come out that Obama was never eligible for the Office of the President.

  21. IMHO, every voting citizen has standing because fraud or double/fraudulent votes water down said citizen's vote.
