President Trump Had Every Right to Pardon Tina Peters Because Biden’s Federal Agencies Were All Over the Tina Peters Case

The Federal Government was totally involved in Tina Peters’ investigation and arrest, which is a key reason President Trump has the right to pardon Tina Peters.

Former Mesa County, Colorado Election Clerk Tina Peters broke no state or federal laws by backing up her Election Management Server (EMS) hard drive, having it analyzed, and even publishing the results.  If she had, the federal and Colorado state governments would have legally come down on her for doing so, especially during the Biden administration.

In other words, not one state or federal charge resulted from Tina’s actions backing up her county’s server.  Because they had NOTHING, Colorado (likely at the behest of the DOJ) had to manufacture imaginary felonies and misdemeanors against Clerk Peters and then prosecute her in the state courts.

He had the absolute right and duty to do so.  There is ample evidence that the federal government under Biden was involved in the Tina Peters case, which supports the argument that, because the federal government led the effort, directed it, or was a large part of the effort to indict and imprison Tina Peters, President Trump can pardon her.

The FBI issued a statement almost immediately after Peters came forward, stating that they would investigate her for potential violations of federal laws. The Biden regime never formally prosecuted Tina, but it appears that Biden’s Department of Justice was working closely with local Colorado officials who sought to put Peters in jail. The Mesa County District Attorney, Dan Rubinstein, included Matthew Kirsh, the United States Attorney for Colorado, in a May 17, 2022, email to multiple District Attorneys across Colorado. The email is titled “Rule 3.8 Meeting” which appears to reference the rules of professional conduct for prosecutors. Email from Dan Rubinstein to DOJ attorney and Colorado District Attorneys, apparently brainstorming how to appear legitimate and ethical while prosecuting Tina Peters

The email suggests that Rubinstein was having some trouble reconciling the prosecution of Tina Peters with prosecutors’ rules of professional conduct and had to call in the cavalry to help him brainstorm ways to avoid being “accused of wrongdoing.”

First, Rubinstein appears to recognize that there is no precedent for the prosecution he wants to undertake, as he expresses a desire that this group of legal minds start writing opinions and issuing guidance documents in the vein of the Colorado Bar Association (CBA) and the Colorado District Attorneys’ Council (CDAC). Without a coherent legal pathway for prosecution, it appears Rubinstein encouraged this course of action to give prosecutors cover.

Second, Rubinstein notes that it is problematic that they have no formal appointments from a government body to lay the groundwork to prosecute Peters.

Third, Rubinstein informs the group of their need to anticipate defending themselves as to why they didn’t seek an opinion on Peter’s case from the Colorado Bar Association Ethics Commission. Rubinstein and his cronies appear to have succeeded in giving their efforts the veneer of legitimacy because three months after this email was sent, Peters was indicted by a grand jury. Another glaring piece of evidence that the Tina Peters case was led by the federal government is that if this was ‘only a Colorado issue’, why were US Attorney General Merrick Garland and Christopher Wray participating in initial Mesa County discussions via Webex regarding the findings of Clerk Peters and her actions related to those findings?

We also know that the full force of the federal government was directly applied to those associated with Tina’s situation, in that the FBI raided Tina’s home.

In addition, Tina’s associate, Sherronna Bishop, ’s home also raided by the FBI.

Also, ‘My Pillow’ CEO Mike Lindell was also targeted by the FBI, and they confiscated his phone while he was traveling in Minnesota.  These were federal actions.  He was communicating with Tina Peters and offered her his support.

Peters was convicted of first-degree official misconduct, violation of duty, and identity theft.

The official statement behind Tina Peters’ indictment included mention of the federal government,

 The Mesa County District Attorney’s Office and the Colorado Attorney General’s Office assisted the FBI in the operation, which was described by Mesa County spokesperson Stephanie Reecy as “federally-authorized law enforcement actions into potential criminal activity by employees of the Mesa County Clerk and Recorder’s Office and others associated with those employees.”  Read all about it HERE.

Joe Hoft was on AON a year and a half ago with Dan Ball, and he mentioned that there is an avenue for President Trump to pardon Tina Peters.  If the federal government was behind her arrest and her indictments, or if they ran the operation against Tina, there is good reason to believe that this was a federal operation.  This would open an avenue for President Trump to pardon Tina Peters.

  5. If Trump can dig into the federal side of the case and find misconduct, then it could lead to Tina's state conviction being overturned. Without federal influence, the grand jury indictment may have never gone through in the first place. And if jurors were lied to, that's blatant perjury.

    My question: assuming he found evidence of fraud in the machines he broke into… where the heck is the evidence today? It could have exonerated Ms. Peters!

They had already tried her in the local newspaper that had published 600 plus negative to Tina front page articles accusing her of the crimes Dominion and Jena Griswold had committed. All the crimes Judge Barrett committed denying Tina her legal and Constitutional right guaranteed the outcome. As a Vietnam veteran I am sickened by the actions of the elected officials in my home county.

Joe is trying to say that because the state prosecutors consulted with federal prosecutors on the case before bringing state charges that this somehow makes the state charges eligible to be pardoned by the president. I don't think any courts are going to agree with Joe on that interpretation.

While I agree that the persecution and conviction of Peters is morally wrong, she was nevertheless prosecuted under state law and state court. Rather going down the path of unconstitutional pardons, Peter's attorney needs to file a federal court action for undue process and under the 14th Amendment Equal Protection Clause. In addition, Trump should have Bond investigate the state officials.

    • There is nothing unconstitutional about President Trump's recent pardon of Tina Peters. The Constitution under Article. II. Section. 2. does NOT carve out any prohibitions on a Presidential Pardon, save one instance and that instance is reserved for Impeachments only. Had the Founding Fathers wanted to restrict the Pardon Power of the President, they would have specifically called them out there and then just as they did in their concern for pardoning impeachments.

      So no, everyone is absolutely wrong in this asinine theory that the President cannot pardon someone for a state crime.

      Fact is, the Constitution of the United States of America is the Supreme Law of the Land and supersedes the Colorado state constitution and Colorado state law; as both were required to be written in complete compliance with the Constitution of the United States of America.

      The Constitution of the United States of America also sets up the president of the entire United States to be the Chief Law Enforcement Officer for all of the United States including Colorado and thus the President ranks higher than the Governor or the CO AG.

      Same goes for the US Supreme Court; the state supreme courts cannot overrule the SCOTUS and they cover all 50 US States and US Territories, as does the jurisdiction of the President as Chief Law Enforcement Officer.

    I think people were assuming this case was handled within the state level but with this revelation the feds were definitely involved, gathering evidence, advising the state Attorney General and prosecutors.

    Now, suddenly, he pardons her… and those exact same commenters who chided me want to know why the pardon won’t get her out?

Most people don't even know what Tina was convicted of, but they are sure are anything that a Presidential pardon will spring her out of jail immediately. It didn't help that Belinda Knisley testified against her and confirmed she let Conan Hayes (not a state employee) have access and copy data from the machines.       As long as US DOJ was communicating with CO state DOJ then you could say the FEDS were involved. However, you could say that was not important also.

While Colorado gets to run the elections in their state, they don't have the right to cheat, destroy records, and imprison innocent people to hide their theft of an election. It is time that the DOJ raid the SOS office, and the prison, and confiscate all emails and records. You know that there are emails between the Governor, Jena Griswold, the corrupt Judge, and the prison officials in this case. That is conspiracy to destroy evidence of a crime, corruption, and conspiracy to violate the Civil Rights of Tina Peters and others.

    This all falls under federal election laws and RICO, and it's past time for Pam Bondi and the FBI to get aggressive in this. I'm sure they've already destroyed most records, but it's very hard to destroy all the email records of anyone those emails went to in the conspiracy and collusion. They only have to find one email that connects them all, then start getting subpoenas requesting the email chains associated with that email. If they are all destroyed, they are all complicit in the coverup of a crime.

    Colorado law is not sovereign and superior in relation the Constitution of the United States of America. The Colorado constitution and laws of the state are all subservient to the Constitution of the United States of America and are to be written in accordance with the Constitution of the United States. The state courts and state supreme courts are all subservient to the US Supreme Court. If you were actually a lawyer, you'd already know this.

    In the very beginning of Article. II. Section 2. It basically states that the President also can take control of the Militia of any State, without the approval of the governor. That right there, and the fact that the Founding Fathers felt compelled to put that bit in there right at the top of the Section.; tells you who's actually in charge here. The states are not sovereign in the respect of sovereign fiefdoms, that their governor can defy the President, nor the will of Congress or even a ruling from the Supreme Court, at will.

    The Amendment X does not supersede Article. II.
